The Last Will and Testament of Jacob Schermerhorn 

The last will and testament Of Jacob Schermerhorn of the town of Broome, county of Schoharie and State of New York.
I Jacob Schermerhorn considering the uncertainly of the mortal life, and being of sound mind and memory do make and publish this my last will and testament. In manner and form following (that is to say) First I give and bequeath to my eldest daughter Polly wife of Peter N. Fink my feather bed, bedstead appendages and the covering commonly used upon the same, winter and summer. Item I give and bequeath to my son William and my daughter Jane (wife of Barnet Stryker 3rd) each a feather bed and the residue of my bedding to be divided between the said William and Jane, share and share alike-which said several legacies I will and order to be paid to the said respective legates within six months after my decease. I further will and devise to my said youngest son William Schermerhorn his herd and aligned one hundred and twenty three acres of land to include the orchard, mansion house and Barn to be laid out in regular form, square or oblong, as near as may be and cut from two certain lots of land formerly owned by the people of this State and signaled as lots Number Six and Number Nine situated in the Town of Broome, County of Schoharie and State aforesaid which lots contain three hundred forty one acres to hold to him the sold William Schermerhorn the one hundred and twenty three acres, to be laid out as aforesaid not leaving any small strip or strife between this quantity and the boundaries of said lots to his heirs and aligns forever. I give and devise unto my youngest son William Schermerhorn, aforesaid, all the residue of the two lots of land, last above described upon the following condition (viz) that if the said William Schermerhorn his heirs executors. Admistrators shall within or at the aspiration of three years after my decease, will and truly pay to the heirs of my son John Schermerhorn such as shall be of the age of twenty-one years, with interest after the expiration of three years after my decease the sum of five hundred thirty one dollar fifty cents to be apportioned as follows, viz, to my grandsons William Francis, Jacob and Harvey each one hundred sixty dollars fifty cents, and to my granddaughter Catherine and Lucina each twenty five dollars. Also to pay in like manner and time to my Grand Children by the first marriage of my son Peter Schermerhorn the sum of five hundred and fifty dollars in the following proportioned, viz, to Abraham and Stryker each the sum of two hundred and fifty dollars and to his daughter Betsy or Elizabeth and the youngest daughter by said first marriage. Lucy Ann or whatever her name may be the sum of twenty five dollars each. Also in like manner and time to my Grand Children by my daughter Hannah, first married to Mr. Mattice, after his death to Stryker Voorhees and is now deceased, leaving three children, viz, John, William, Jerimah and Barnet the sum of twenty five dollars to be apportioned equal (in twenty five dollars each. And also at the aspiration of three years after my decease to pay to my daughter Polly the wife of Peter N. Fink or to her heirs executors, administrators as she may direct the sum of one hundred dollars and also in like manner to my daughter Jane, the wife of Barnet Stryker 3rd the sum of one hundred dollars. That upon my son William Schermerhorn paying to my daughters and grandchildren the several sums as directed to each of them as above mentioned. Then my son William Schermerhorn his heirs and aligns shall have hold and enjoy the whole of my real estate forever. But in case my son William Schermerhorn, his heirs, executers, or administrators shall neglect or refuse to pay to my daughters and Grand Children above mentioned or either of them the specific sum directed to be paid to each. Then I order and direct and this present will and devise is that there shall be set off to each above mentioned unpaid daughter, viz, Floily and Jane each sixteen acres of land, and to my Grandsons William Francis, Jacob and Harvey each twenty six acres and to my grandsons by my son Peter by his first marriage, viz, Abraham And Stryker each Forty Acres. And to my grand daughters and grandsons by my daughter Hannah (deceased) each four acres. All having been particularly mentioned and named above with a particular legacy to be paid to each. But to each and such as the legacy shall not be paid as before directed, there shall be set off to him or her (unpaid as aforesaid) the quantity of land as above foresaid to be taken from any part of the above mentioned two lots of land my son William Schermerhom shall direct after the one hundred twenty three acres devised to him shall be set off to be held and enjoyed by each of my daughters, grand daughters and Grandsons above mentioned and to his, her and their and each of their heirs and aligns forever. And whereas my son Peter by his last marriage has two daughters twins their names unknown I give and bequeath to each of them one small print Bible with seventy five cents each and direct the some to be purchased and delivered to them by my son William Schermerhorn his heirs executors or administrators when they shall have obtained the age of fourteen years. And lastly as to all the rest residue and remainder of my personal estate goods and chaftels of what kind and nature, I give and bequeath the same to my youngest son William Schermerhorn, whom I hereby appoint executor together with John Richtmyer and Abraham Richtmyer of Broom in said County of Schoharie Executors of this my last will and testament, hereby revoking all former wills by me made. In witness where of I have hereto set my hand and seal this sixth day of June in the year of our Lord one thousand eight hundred and twenty nine. Jacob Schermerhorn Signed, sealed, published and declared by the above named Jacob Schermerhorn to be his last will and testament in the presence of us who knew him unto subscribed our names as witness in the presence of the testator.
