LAST WILL AND TESTAMENT OF JOHANNES ENDERS

In the name of God, Amen. I, Johannes Enders of Schoharie in the county of Schoharie and State of New York, considering the uncertainty of this life and being of sound, disposing mind and memory, do make, ordain and publish this, my last will and testament in manner and form following.

First, I give, devise and bequeath unto my beloved wife Elizabeth, all my real and personal estate to have and to hold the same to her for and during her life, provided she shall so long remain my widow. But case she should again marry, then it is my will that the estate hereby given to my said wife shall cease, determine and be at an end. It is my will however, that in case she should again marry, that she shall not be precluded from claiming her dower.
And whereas I have heretofore given and conveyed unto my two daughters, Elizabeth, wife of George McMann and Christina, wife of Josias Swart, the equal undivided half of lot number twenty in the first allotment of Lawyer and _____patents. Therefore, that my other daughters may receive a proportion on my estate equal thereto. 
Secondly, I give and devise unto my daughter Maria, wife of John George Kniskern, the equal undivided half of all my land in lot number one hundred and thirty five in a patent granted to Myndert Schuyler and others, situated in Schoharie in the county of Schoharie. Also, lot number eleven and the equal undivided half of lot number eighteen and the equal undivided half of all my land in lot number two in a patent granted to Augustus Van Courtlandt, situated at Schoharie aforesaid. To have and to hold the same to her, her heirs and assigns forever, subject to the estate herein before given to my said wife, and subject also to the condition herein after mentioned.
Thirdly, To my daughter Dorothea, wife of Jansen Olmstead, I give and devise the other equal undivided half of all my land in said lot number one hundred and thirty five in the aforesaid patent granted to Myndert Schuyler and others. Also lot number nine and my other equal undivided half of lot number eighteen and the equal undivided half of all my land in lot number two in the said patent granted to Augustus Van Courtlandt, to have and to hold the same to her, her heirs and assigns forever, subject to the said estate herein before given to my said wife.
Fourthly, To William Frederick Shout, son of said daughter Dorothea by her former husband William Shout, I give and I devise twenty acres of land, part of the farm on which I now live and to include my house and barn and out buildings and to be taken off from that part of my said farm adjoining the farm now in the possession of John Jost Sidney, to have and to hold, the same to him, his heirs and assigns forever, subject to the said estate herein before given to my said wife.
Fifthly, To Anna Dorothea Shout and George Jefferson Shout, children of my said daughter Dorothea, by her said former husband William Shout, I give and devise all my land in the aforesaid patent granted to Augustus Van Courtlandt, which lies to the north and west of the Schoharie Creek to be equally divided between them, share and share alike and to their and each of their respective heirs and assigns forever, subject to the said estate herein before given to my said wife. 
Sixthly, All the rest and residue of my estate, real and personal where so ever situated. I give, devise and bequeath unto my four daughters, namely, Maria, wife of John George Kniskern, Elizabeth, wife of George McMann, Christsina, wife of Josias Swart and Dorothea, wife of Jansen Olmstead, to be equally divided between them, share and share alike, and to their heirs and assigns forever. Subject however to the said estate herein before given to my said wife.
In the event however, that my said daughter Maria, wife of the said John George Kniskern should die without issue living at the time of her death, then it is my will that the estate herein before given and devised to her, shall on her death to and vest in my other children living at the time of her death and to the children of each of my children as may be dead at the time of her death in like manner as they would take the same by them as heirs of my said daughter Maria.
Lastly, I do hereby constitute and appoint my sons in law John George Kniskern, George W. Mann, Josias Swart and Jansen Olmstead executors of this my last will and testament, hereby revoking all former wills by me made. In witness where of I have hereunto set my hand and seal, this ninth day of march in the year of our Lord one thousand eight hundred and twenty five.

State of New York, Schoharie County. Be it remembered, that on the fourth day of April in the year of our Lord one thousand eight hundred and twenty five, personally appeared before me, William Mann, Surrogate of the county of Schoharie, aforesaid Peter Enders, Junior, Jacob P. Enders and Henry Hamilton, the subscribing witnesses to the will of Johannes Enders, late of the town of Schoharie in the said county. Deceased, who being duly sworn, declared that they did see the said Johannes Enders, deceased, seal and execute the instrument hereunto annexed and impressed with the seal of office of said surrogate, which instrument purports to be the last will and testament of said Johannes Enders, deceased, bearing date the ninth day of March in the year of our Lord One thousand eight hundred and twenty five. That they heard him, the said Johannes Enders, publish and declare the same as and for his last will and testament. That at the time thereof, he, the said Johannes was of sound, disposing mind and memory to the best knowledge and belief of them, the said witnesses and that they did personally subscribe their names thereto as witnesses in the presence of the testator and of each other. In testimony whereof the said Surrogate hath hereunto set his hand and affixed his seal of 


office, the fourth day of April in the year of our Lord, one thousand eight hundred and twenty five.

Letter Testamentary upon the will of Johannes Enders, Deceased

The people of the State of New York by the grace of God, free and independent. To all to whom these presents may come or may concern, send greetings. Know ye, that at the town of Schoharie in the county of Schoharie, on the fourth day of April in the year of our Lord one thousand eight hundred and twenty five, before me, William Mann esquire, Surrogate of our said county, the last will and testament of Johannes Enders, deceased, (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us. The said deceased having whilst he lived and at the time of his death, goods, chattels or credits within this State, by means whereof the proving and registering the said will, and granting administration of all and singular the said goods, chattels and credits, and also the auditing allowing and final discharging the account thereof, doth belong unto us. The administration of all and singular, the goods, chattels and credits of the said deceased and any way concerning his will is granted unto John George Kniskern, George McMann, Josias Swart and Jansen Olmstead in the said will named. They being first duly sworn, will and faithfully to administer the same, and to make and ____ but a true and perfect inventory of all and singular the said goods, chattels, and credits and also to enter a just and true account thereof when thereunto required. In testimony whereof, we have caused the seal of office of our said Surrogate, to be hereunto affixed.
