State of New York Surrogate's Court
County of Montgomery
In the matter of proving the will of
Julius Fredericks
Frederick Shinnemann of the village of Canajoharie in
the county of Montgomery and William Fredericks of the
village of Canajoharie in the county of Montgomery
being duly sworn and examined in open court before
Surrogate of said county, do depose and say, and each
for himself deposeth and saith that he was acquainted
with Julius Fredericks in his lifetime, and was
present and saw the said Julius Fredericks subscribe
his name at the end of the instrument in writing now
produced and shown, bearing date the 17th day of March
1898 that the said Testator at the time he so
subscribed it, declared that the said instrument to be
last will and testament and requested these deponents
to subscribe their names as witnesses to the execution
thereof. Thereupon these deponents subscribed their
names as witnesses at the end of said instrument in
the presence of the said Julius Fredericks and of each
other. That the said Julius Fredericks at the time he
so executed the said instrument was a citizen of the
United States, an inhabitant of the County of
Montgomery, of full age, of sound and disposing mind
and memory, and in all respects competent to devise
real estate, and not under any restraint or in any
respects incompetent to devise real estate, and was in
all respects competent to make a valid will.

Taken, subscribed and sworn this 9th day of April,1900
before me
     W.Barlow Dunlap
I W. Barlow Dunlap Surrogate of the County of
Montgomery, do hereby certify that the foregoing are
true copies of the will, probate and proof of Julius
Fredericks deceased.

Be it remembered, that heretofore, to wit, on the 26th
day of March,1900 Louisa Fredericks the executrix
named in the last will and testament of Julius
Fredericks late of the town of Canajoharie in the
county of Montgomery, deceased, appeared in open court
before Hon. W. Barlow Dunlap Surrogate of said county,
and made application to have the said last will and
testament which relates to both real and personal
property proved; and on such application the said
Surrogate did ascertain by satisfactory evidence who
were the widow, heirs and next of kin of said testator
and their residences and the Surrogate did thereupon
issue a citation, in due form of law, directed to the
said persons aforesaid by their respective names,
requiring them to appear before said Surrogate at his
office in the village of Fonda on the ninth day of
April 1900, to attend the probate of said will. And
after wards, to wit, on the ninth day of April 1900,
satisfactory evidence by affidavit was produced and
presented to the said Surrogate of the due services of
said citation in the mode prescribed by law, and on
that day proponent by B. Fred Sprahter her attorney
appeared, and Hinau L. Huston appeared as Special
Guardian of Julius Fredericks, Jr., Frank Fredericks,
and Catharine Fredericks and no one appearing to
oppose the probate of said will, such proceedings were
thereupon had afterwards that the said Surrogate took
the proof of said will herein after set forth upon
this ninth day of April in the year one thousand nine
hundred; and he adjudged the said will to be a will
valid to pass real and personal property, and the
proofs thereof are as follows, that is to say:

  Last will and testament,
I, Julius Fredericks of the town of Canajoharie,
County of Montgomery and State of New York, do make
ordain publish and declare this to be my last will and
testament, in manner and form following
That is to say,
First, I direct the payment of my just debts if any
Second, I give devise and bequeath unto my wife Louisa
Frederick of the town of Canajoharie aforesaid all of
my property real and personal and mixed wheresoever
situated, for and during her natural life, or so long
as she shall remain my widow.
Third, Upon the death or marriage of my said wife
Louisa Frederick, I give devise and bequeath all of my
said property aforesaid to my children Mary
Groffenair, John Frederick, Charles Frederick, Augusta
Hambracht, Louisa Frederick, Elizabeth Abeling,
Caroline Frederick, Julius Frederick, Jr.,
Catharine Frederick, and Frank Frederick, to be
divided among them equally share and share alike.
Likewise, I make constitute and appoint my wife Louisa
Executrix of this my last will and testament hereby
revoking all former wills made by me.
In witness whereof, I have here into subscribed my
name and affixed my seal the 17th Day of March in the
year of our Lord one thousand eight hundred and ninety

The above written instrument was subscribed by Julius
Frederick in our presence and acknowledged by him to
each of us and he at the same time declared the above
instrument so subscribed by him to be his last will
and testament, and we at his request, sign our names
as attesting witness hereto, in his presence and in
the presence of each other and write our names our
respective places of residence.
