Record of the last will and Testament of Gertrude B.
Flagler deceased. Be it remembered that upon due
application for that purpose to the surrogate of the
County of Dutchess citations were duly issued by the
Surrogate requiring the heirs and next of kin of said
deceased to attend the probate of said will which
citations were duly returned to said Surrogate with
the proof of service thereof and the proper parties
being in court such proceedings were thereupon has
that the said will was admitted to probate as a will
of Real and Personal Estate after hearing the proofs
and examinations of the witnesses which said last will
and testament together with the proofs and
examinations of the witnesses aforesaid are as
follows, that is to say-
The last will and testament of Gertrude B. Flagler of
the village of Poughkeepsie, County of Dutchess and
State of New York, widow of Thomas Flagler late
deceased witnesseth as following to wit, After payment
of all the just claims against my estate I devise and
bequeath to my executor the sum of four thousand
dollars in trust to be invested by him according to
his best judgment and the interest at six percent to
be equally divided between my mother Phebe Stockholm
and my brother Derick B. Stockholm annually so long as
they shall both live, at the decease of either the
other shall be entitled to the whole of the said
interest each and every year during his of her natural
life, after the decease of both the one half of the
said four thousand dollars shall be equally divided
between the children of my late brother George
Stockholm deceased, the remaining half I give and
bequeath to John S. Flagler, son of my late husband,
Thomas Flagler and his heirs. I also bequeath to my
executor in trust the sum of three thousand dollars
the interest of which at six percent he shall annually
pay to Phebe, wife of Daniel D. Jones of Beekman
during her natural life, after her decease the said
three thousand dollars shall be equally divided
between Aaron S., Maria, Helen,and David children of
the said Daniel D. Jones. For the safety of the
aforementioned trusts my executor shall exercise all
proper care and diligence, but if in the exercises of
such care any loss shall accrue to either or both
trusts he shall not be responsible for such loss. All
my wearing apparel of every description I give and
bequeath to the said Phebe Jones and her heirs. I give
and bequeath my silver tea set consisting of one tea
pot, one cream pot and one sugar cup marked G.B.S. to
Mary G. wife of Charles G. Curtis and her heirs. I
give and bequeath one plate cake basket marked G.B.S.
to Phebe D. Payntar and her heirs. I give and bequeath
to Maria, daughter of the said Daniel D. and Phebe
Jones one dozen silver tea spoons marked G.B.S. also
one butter knife marked G.B.S. and to her sister Helen
three silver table spoons and one butter knife each
marked G.B.S. I give and bequeath to Gertrude,
daughter of my late brother George Stockholm deceased
my large family Bible. I devise and bequeath all the
rest and residue of my estate both real and personal
to the aforementioned John P.Flagler and his heirs and
assigns forever whether the same be in my name or the
name of any other persons as my trustee or otherwise-
I hereby constitute and appoint John B. Flagler of
Pokeepsie aforesaid sole executor of this my last will
and testament hereby revoking all former wills by me
made. In witness whereof I have here unto set my hand
and seal this twenty ninth day of December one
thousand eight hundred and forty nine.

The above instrument (of two pages) was at the date
thereof now here subscribed by Gertrude B. Flagler the
testatrix in the presence of each of us and was at the
same time declared by her to be her last will and
testament and we at her request sign our names hereto
as attesting witnesses on first page interlines.

In the matter of proving the last will and testament
of Gertrude B. Flagler deceased
Dutchess County- Travis Brinkerhoff of the town of
East Fishkill in the county of Dutchess being duly
sworn and examined doth depose and say that this
deponent was present as a witness well acquainted with
Gertrude B.Flagler the above named testatrix late of
the town of East Fishkill in the county of Dutchess
deceased. That this deponent was present as a witness
and did see the said testatrix subscribe her name at
the end thereof the instrument now produced and shown
to this deponent purporting to be the last will and
testament of said deceased bearing date the twenty
ninth day of December in the year of our Lord one
thousand eight hundred and forty nine- that the said
testatrix at the same time declared the instrument so
subscribed by her to be her last will and testament.
That there upon the deponent and Thomas M. Bresser
severally subscribed their names at the end thereof as
witnesses thereto at the request of the testatrix and
in her presence and that the said testatrix at the
time of executing and publishing the said last will
and testament was of full age, of sound mind and
memory and not under any restraint.
From this 9th day of March 1855 before me-

Dutchess County: Thomas M. Bresser of the town of
Poughkeepsie in the County of Dutchess being duly
sworn doth depose and say that this deponent was well
acquainted with Gertude B. Flagler the above named
testatrix late of the town of East Fishkill in the
County of Dutchess deceased. That this deponent was
present as a witness and did see the said testatrix
subscribe her name at the end thereof the instrument
now produced and shown to this deponent purporting to
be the last will and testament of the said deceased
bearing date the twenty ninth day of December in the
year of our Lord one thousand eight hundred forty
nine. That the said testatrix at the same time
declared the instrument so subscribed by her to be her
last will and testament. That thereupon the deponent
and Travis Brinkerhoff severally subscribed their
names at the end thereof as witnesses thereto at the
request of the testatrix and in her presence and that
the said testatrix at the time executing and
publishing the said last will and testament was of
full age, of sound mind and memory and not under any
restraint.

Surrogates office recorded the preceding last will
and testament (together with the proofs and
examinations taken thereon) which record is hereby
signed and certified by me pursuant to the provisions
of the Renico Statute of this state in each case made
and recorded this 9th day of March A.D. 1855.
